1. Acceptance of Terms

By accessing or using any services provided by JAI Tech ("we", "us", or "our"), including the website jaitech.ai, JAI Portal (jaiportal.com), our mobile applications, and web platforms, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms apply to all users, including visitors, registered users, and subscribers of our services.

2. Description of Services

JAI Tech provides AI-powered products and services, including but not limited to:

  • JAI Portal: An AI platform offering 500+ AI models for image generation, video generation, AI chat, AI agents, upscaling, website building, and more.
  • Mobile Applications: Editor AI, PodGenie, Daily Amal, Short & More, BeautifAI, Housify AI, and other applications available on iOS and Android.
  • Web Platforms: Vetly, EduTalk, TherapyTalk, UsualAI, and other AI-powered web services.
  • Enterprise Solutions: Custom AI development, consulting, and workflow automation for businesses.

3. Account Registration

  • You must be at least 16 years old to create an account and use our services.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate, current, and complete information during registration.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use our services to:

  • Generate, upload, or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Create deepfakes, non-consensual intimate imagery, or content that impersonates real individuals without their consent.
  • Generate content that promotes violence, terrorism, hate speech, discrimination, or exploitation of minors.
  • Infringe upon intellectual property rights, trademarks, or copyrights of third parties.
  • Attempt to reverse-engineer, decompile, or extract source code from our AI models or software.
  • Use automated systems (bots, scrapers) to access our services without authorization.
  • Overload, disrupt, or interfere with the operation of our services or infrastructure.
  • Use our services for any fraudulent, deceptive, or misleading purposes.
  • Violate any applicable local, national, or international law or regulation.

We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

5. AI-Generated Content

5.1 Ownership

Content you create using our AI tools is subject to the following: you retain ownership of your original input (prompts, uploaded images, etc.). AI-generated outputs are provided to you under a license for personal and commercial use, subject to these Terms and applicable laws.

5.2 Limitations

  • AI-generated content may not be unique; other users may generate similar or identical outputs.
  • We do not guarantee that AI-generated content is free from errors, biases, or inaccuracies.
  • You are solely responsible for reviewing and verifying AI-generated content before use.
  • You must not represent AI-generated content as human-created in contexts where such distinction is legally required.

5.3 Content Moderation

We employ automated and manual content moderation systems to prevent misuse. We reserve the right to block, filter, or remove content that violates our policies.

6. Subscriptions & Payments

  • Our products use different payment models. JAI Portal operates on a pay-as-you-go (credit-based) system where you purchase credits and use them as needed. Some of our mobile applications may offer subscription plans or one-time purchases.
  • For subscription-based products, subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time through your account settings or the respective app store.
  • For pay-as-you-go products, purchased credits are non-refundable unless otherwise stated. Unused credits remain in your account until used.
  • Refunds for app store purchases are handled in accordance with the applicable app store policies (Apple App Store, Google Play Store).
  • We reserve the right to change pricing with reasonable notice. Existing credits and active subscriptions will be honored.
  • Free tiers or trial periods may be offered at our discretion and may be modified or discontinued at any time.

7. Intellectual Property

All content, features, functionality, trademarks, logos, and technology associated with our services are owned by JAI Tech or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.

The JAI Tech name, JAI Portal name, and associated logos are trademarks of JAI Tech. Unauthorized use is prohibited.

8. Third-Party Services

Our services may integrate with or contain links to third-party services, APIs, or platforms. We are not responsible for the content, terms, or privacy practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

9. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

  • Our services will be uninterrupted, error-free, or secure.
  • AI-generated results will be accurate, complete, or fit for any particular purpose.
  • Any defects or errors will be corrected in a specific timeframe.

You acknowledge that AI technology is evolving, and results may vary. You use our services at your own discretion and risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, JAI Tech and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our services.

Our total liability for any claims arising from the use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless JAI Tech and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to our services at any time, with or without cause and with or without notice. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitation of liability) will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the jurisdiction in which JAI Tech is established.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our services or via email. Your continued use of our services after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using our services.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.
